Understanding lien waivers
A lien waiver is a signed statement from a contractor, subcontractor, or supplier waiving lien rights up to the amount they've been paid. Owners collect them at each payment to protect the property from surprise liens.
Four types of lien waiver
- Conditional progress — waives rights up to a progress payment, only effective once payment clears
- Unconditional progress — waives rights immediately for a progress payment received
- Conditional final — waives all rights on final payment, effective once payment clears
- Unconditional final — waives all lien rights immediately
